SAFE Act Compliance: Licensing & Registration Requirements for Mortgage Loan Originators
Under the Secure and Fair Enforcement for Mortgage Licensing (SAFE) Act of 2008, individuals engaged in residential mortgage loan origination must either be state-licensed or federally registered. However, employees of federally regulated depository institutions, such as federal credit unions, are exempt from state licensing requirements but must register with the Nationwide Mortgage Licensing System and Registry (NMLS) and obtain a unique identifier.
How can GRO Group originate nationally?
Real estate agents employed by a federal credit union, like Capital Federal Credit Union, can originate loans nationwide without obtaining state-specific licenses, provided they are registered with the NMLS. This federal registration allows them to operate across state lines under the supervision of their employing institution.
What is the FHA and HUD say about this program?
In addition, on December 15, 2022, the FHA published Mortgagee Letter 2022-22, which revised their conflict of interest and dual employment policy. This policy allows individuals to have multiple compensated roles for services performed by HUD, as long as the transaction complies with all applicable laws, rules, and requirements.
What is the role of federal oversight?
It's important to note that while federal registration exempts these individuals from state licensing exams, they are still subject to federal oversight and must comply with all applicable regulations and registration requirements.
How is it legal for a real estate agent to work as a loan processor without an NMLS license?
According to the Secure and Fair Enforcement for Mortgage Licensing (SAFE) Act, individuals performing loan processing activities under the supervision of a licensed mortgage loan originator (MLO) are not required to obtain an NMLS license. The SAFE Act specifies that loan processing and underwriting activities are not covered under the licensing requirements for MLOs.
